Hi,
I received an RFE for my Birth Certificate as the Originals were not available as it was submitted to the school during admissions and when i spoke to them they said that we cannot issue you the original certificate. So i went to my native and requested the Municipal to issue me a BC and they agreed and issued me a copy with all the details but the certificate was dated March 2009 as the issuing date which was not accepted by the USCIS and they sent me a RFE for my birth certificate.
I have read the posts on this forum but none of them relates to my issue. I have a duplicate copy issued by the Municipal Authority which contains the seal and signature of the authorized gazetted officer. This is the same certificate which was submitted to the embassy and based on which i received my K1 Visa. What should i do? Please this is very very urgent as i have to submit the RFE by end of this month. Can i just submit a letter with 2 affidavit's from my family explaining to them that in India you don't receive birt certificate back from school or the graduation certificates do not contain your parents name and place of birth.
what is my best way to tackle this Rfe?

Two weeks ago I received an RFE for my E-Filed I-131 Advance Parole.
They requested two passport-style Photos but didn't mention where to send the RFE response.
However, on the top right-corner (next to the US Dept. Homeland security Logo) on the RFE page, there is an address (P.O Box 852381 Mesquite, Texas 75185-2381).
Underneath of the Director signature it has Officer # 159.
I'm really confused
1. Which address to send the RFE response?
2. Attention to what??? (Should I put Attn: to this officer # 159)
Please guide me ASAP...

Refer processing times at https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC and search for "All other applicants for advance parole". Right now they are processing July 03, 2007 cases.

You can do Info pass and ask for both. Alternatively, you can try calling USCIS when your priority date is current and ask for this information. If you are lucky, they will tell you whether or not there are any security checks are pending. People noted that there are no LUD when NC gets through. On the other hand, if one has a FP and a couple of days later there is a LUD on I485, that often means FP cleared. Remember that FP and NC are completely separate tasks.

It might not be related. My wife had a miscarriage on her 12th week. She didnt have to take the shots since we already had the records. But she did took TB skin test. I dont think they are related. We are just unlucky.

I think someone has given you incorrect information.
A visitor can stay for a maximum of 6 months (180 days - unless person is given earlier date in I-94, which is not usual) At a stretch. If person returns before 180 days, he/she can come back within a day and get a new I-94 and again can stay for 6 months (180 days or the date written on new I-94).
So, person's stay is not governed by number of days in a year, but by the date which is written on I-94. As long as she gets new I-94 with new date, she can stay until that date.
As a side note, what you are confusing with is the tax requirements, which is: If you are claiming a person to be your dependent, he/she must have stayed in the country for atleast 6 months in a calendar year.

No 1099 needs to be filed by the entity writing the check, if the amount is less than $600. Declare it as "Other Income" (probably with a Schedule "C", please check) on your tax return. Check IRS.GOV and www.investsafe.com/language.html

I think you should talk to a good lawyer immidiately. Waiting here for someone to answer would jeopardise your relatives entry back into US later. As per the law they should be leaving US as soon as you get the denials.

EAD is employment authorization document. Your analogy is like -
"Can I use her driving licence to drive around town". I am not sure if that is what you meant.
If you want her to be the primary applicant in your GC application and then use EAD as a dependent, that is possible. You will lose your H1B status then.

Last October I hired a lawyer for an AOS ( I-485 ) and the I-130 and I-131 forms.
Obviously I did it because I did not have any knowledge about immigration matters.
In Novembre 2007 he did contact me telling me I needed the I-765 form to legally work in the country, so I did fill the form sending it in his office by mail.
He told me he sent the form in the first week of December 2007.
Ok now this is the situation :
I never get by mail the notice of action about the form I-765 and what concern me the most is that I still did not get the permit to work.
I periodically check the processing time cases from the USCIS' website, and I have seen that USCIS (NEW YORK area ) already processed the I-765 forms for the complete month of December, does anyone know if Uscis is having problem processing EADs....I am really worried that something did not go through... probably it's just normal to have so many questions but recently I think about that all the time.
Oh guys one more thing...I paid this lawyer thousand and thousand of dollars.
I realized reading the USCIS website that if you fill the form I-485 you are not required to pay the $ 340 fee for the I-765 form . Last November he asked me to send him a check for the EAD fee. When I told him that last time i spoke with him by phone he said he did know that , then he told me that he just had moved from his old office to a new one so my case was in storage, in storage ?? My case is still pending and he put it in storage, i am so disappointed ...unbelievable this lack of professionality.
I should have do it by myself at least now I would have money to buy a nice used car.

Hello All,
I have a certain queries regarding the transfer from L2 to H1B.
My husband is on L1 and me on L2 with my EAD still under processing. However my husband's firm wants to get his visa converted to H1 which automatically cancels my L2 status and I would have to apply for H4.
So now my query is for how long will his status of L1 be valid will it be till the start date of H1B, or the minute he files in his papers for H1B or when his H1B gets approved?

Hello all,
First some background:
I purchased a house this September and my apartment lease expires end of Sept. So I am basically living at both places and moving slowly. Anyway my USPS mail forwarding starts from 9/21.
As far as immigration and change of address goes, based on my lawyers advise...I filled out the online AR-11 change of address and also updated address change for my 485/ap/ead ( I am a july 2nd candidate) pending cases as well. However, after downloading the pdf version of the AR-11 I realized I misspell "Lane" to "Land." Don't know if this is a huge problem. Anyway can I re-file the AR-11 and change of address for all the pending petitions again for myself and my spouse? Does anyone have any thoughts or could share their experience? I read somewhere its also a good idea to update address with local office by getting info pass appointment? Any comments/ thoughts?
Also, in the AR-11 form I didn't provide email address, is that a big deal?

Non-profit organizations...as the name emplies are organizations that doesnt aim to make a profit...and if they ever do, it must be retained within the organization so they can support their own programs and services. Examples are foundations, charities--they are tax favored. I know some schools are too---and hospitals. Ive worked in one hospital before. You can find it out by reading what a company is all about...visions, missions...they will usually say they are not for profit organizations if ever they are...hope this helps....by the way...they are VISA CAP EXEMPT!

It is very unikely that the US consulate in London will accept your visa application unless you have close ties to the UK. You will probably need to apply in India, or consider Canada or Mexico.
