My I-140 is also pending in Nebraska, I am also in EB-3 category with labor PD 02/20/2007. Your labor PD is 03/2007 and hence it is surprising! I saw an approval for one EB-3 filed in April 2007 in but his PD is 2002.
I do not see any LUD these days in my pending I-140 and I-485. There was a soft LUD in my wife's I-765 (EAD already approved and received) about a month back.
Please keep us updated.

Just wanted to find out if you were aware if it makes any difference as to where you get your receipt from-- with respect to making an appointment(location).
What I mean is, would it be OK to get receipt from a HDFC branch in Mumbai, if you were going to make an appointment with New Delhi Embassy ?

Applications were sent to NSC on July 19th' 2007. I got my receipt numbers today and all three numbers (I485, EAD & AP) start with WAC ### ### ####. The online status for the applications say that the 485 application was transfered to Texas Service Center and the EAD & AP applications were sent to Califorina Service Center.
Also just fyi, my I-140 app. is pending at NSC since Dec' 2006. So now I am all over the country :-)
Don't know its good or bad. Any idea anyone?

Dear IV Friends,
Please help us with your suggestions/ideas. My Wife's 485 application is pending along with her EAD and AP. She applied on Aug-1st and received the receipt notice on Aug-12th for her AP and EAD. My G.C. got approved and I received the card in the mail. (Earlier I was on H-1 and she was on H-4).
My wife got a job offer and the company will wait until she gets her card to formally get her on board.
Now she wants to visit India before she can join the job. Is there any way she can go to India and come back?

Friends,
I have the following situation, any help/pointers is much appreciated:
- Have EAD (expired Sep 2010). H1B expires Dec 20, 2009.
- I was informed sometime back that I am going to be laid off mid September (next week)
- I am expecting another job offer (interview went well and most likely will get the job) and plan to start at that job late September / eraly October 2009.
- The new offer that I am expecting to get is for the position of Senior Software Engineer, whereas my previous position (where I will be laid off from) was Software Engineer.
So, my questions are:
1. Is it still possible to transfer my H1B visa even though I expect a gap of atleast 2 weeks between the two jobs, or is it better to switch over to the EAD?
2. Will it be a problem for my pending 485 application if my position changes to Senior Software Engr? (although the responsibilities in both positions are about 95% similar, few more responsibilities as a Senior Eng, thats all)
3. If I end up changing over to EAD, what next steps should I do (wrt keeping my 485 applicationb alive and to inform USCIS that I have switched over to EAD).
4. A few months before I got the notice of layoff, I got engaged to a woman in India. I would have preferred to get married by end of the year (would have applied for 1yr extension of H1b) so that my wife could have come over on H4 visa. Now, if I switch over to EAD, what are the options of bringing my (to be) wife over? Is this going to be a problem?

Your parents can visit you for short trips as often as they like (within reason). But if they stay for an extended period (ie. the full 6 months stamped on the I94), then there is an implicit time gap requirement. In other words if your parents stay with you for 6 months then go back to their country and return to the US after 1 month, most likely they will not get a 6 month stamp the second time. In this scenario they might have plan their trip back to the US after 9 month or so. On the other hand if your parent stay with you for 1 month in the US, then leave for an other country and come back in 15 days, they should not have a problem with re-entry.

Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Effective January 4, 2010, the U.S. Department of Health and Human Services, Center for Disease Control and Prevention (HHS/CDC) is removing HIV from the list of communicable diseases of public health significance and references to HIV from the scope of medical examinations for foreign nationals.
Until the rule goes into effect, non-citizens who are HIV-positive cannot be admitted into the U.S. unless the U.S. Department of Homeland Security (DHS) grants a waiver. Once the rule goes into effect on January 4, 2010, HIV infection will no longer be defined as a communicable disease of public health significance, immigrant visa applicants who are required to undergo a medical screening exam will no longer be tested for HIV, a waiver for entry into the U.S. will no longer be necessary, and HIV-positive visa applicants will not be found ineligible for visas under Section 212(a)(1)(A)(i) of the Immigration and Nationality Act (INA). Although foreign nationals with HIV who apply for visas will no longer be ineligible under INA Section 212(a)(1)(A)(i), they still must overcome the public charge under INA Section 212(a)(4) by demonstrating to the consular officers that they will have the means of support in the U.S. and that they will not need to seek public financial assistance. Hello,
Here is my situation - I have filed my I140 and I485 through company A and still waiting on a receipt number for the I485 (filed on July 2007). I have gotten a new job offer with company B. My questions -
1) If I were to transfer my H1B to company B, what would happen to the GC process that I initiated with company A?
2) Also, is it possible to revoke the GC application? If yes, are the filing fees refunded?

I have a question regarding AP. I have AP's based on my pending 485. Recently i traveled to India (on a family emergency) using my AP which was issued in 20th Nov 2008 valid till 19th Nov 2009. I had no issues & got thru JFK using the same.
I was out of US from Sep 23rd thru Oct 24th 2009.
Before leaving US I applied for my AP in early Sep, which got approved by Sep 29 and was in my mail box by the time I arrived. The New pay roll has validity from 20 Nov 2009 until 19 Nov 2010.
My question is, I may need to travel to India again for couple of months that is some some time near 5 Nov 2009 & will be back by Jan 2010.
Do you guys foresee any other issues? , I herd that the AP is NOT valid if you are out of the country.

My first camera was a refurb d80 and there was no way to tell the diff between new or used. I bought a new d300 and love the camera but out of the box it seemed to be in the same great condition as the refurb d80.

Guess its easier.. and then they give negative reps instead of answers... Anyway.. Seems IV is losing focus and with this attitude of majority.. many more will go away...
I'll request all contributors to feel proud but don't boast all the time of your contributions and expect contributions from the others rather than questions...

People will contribute at their pace and in the manner they feel good... You just can't force them... without being an example...
