    I am also facing a similar situation. My lawyer advised me not to worry about this.

    Hi guru�s,

    Need some help, I was in US working for a consulting company and a good client for 4 years then due to some family issues I had to return back to India in the beginning of last year �08. I and my wife has visa stamped in passport valid till the end of this year. Now I want to come back to US and I am not sure if I can enter US again with the same visa as I do not have paystub from my employer for last 1.5 years.

    During this 1.5 years I started my own business and tried various options but didn�t work out well so want to return back to US and during this time we had a son who doesn�t have a visa. Does any body know how I can return back to US, are they really strict at port of entry and would not let me in without a project. I don�t have a project right now and will look for it once I am in US. Any input would be very helpful.

    I had a lot of emotional and financial distress upon my graduation and I didn't get to apply for OPT. What do I do?
    I mean I know I need to go speak with the dept that handles intl students in my school?
    But, like, any pointers or information to please assist me?
    Any constructive information/help, will be useful!
    Also, I am looking into getting into graduate school within the next yr to yr and half!

    Should be out by at latest the 15th... the bulletins in the past have been released in a range between 5th to 15th of the month.
    I think with the Columbus Day holiday recently, they might take an additional day to release.

    hello all,

    I wanted a clarification regarding address change:

    My company changed address recently from address City A to address City B (same county, same metropolitan area). Do you know if I need to do any LCA Amendment?
    I had consulted a lawyer regarding this, he said we don't need to do any LCA Amendment since it is the same metropolitan area.
    Also I am not getting any clear answers from any other websites.

    Wanted to cross check with you all. If anybody know please help.

    I can't say which is right, but I can share my information (so far). My EAD was supposedly sent Sept. 5th. On Oct. 4th when I had not received it, I called USCIS and spoke to CSR, who put in a request for a resend of the card. I still have not received it, so after 45 days (the requested wait this time) I called again today. I have another service request number now and am told to wait another 45 days... At least the CSR admited she didn't think anything was done after I called in October! I wonder how many "45 days" they want me to wait!

    Hi,
    My wife has FP appointment scheduled for 12/29/07, She is in india now. I have returned from india today only(12/28) and saw the FP appointment. Can i reschedule FP one day before the appointment date? If i send the reschedule request today will USCIS accept it? since there is only one day left. Please advice me.

    Hi Sunil

    On 11/27 last month you said that you had received your FP appointment notice and you want to reschedule it . Did you not do it at that time ? Is this the second time you want to reschedule.

    The procedure is the same as explained in your first post and yes you can reschedule it one day before it is due ( but I would strongly advise against it if this is the second time you want to reschedule ).

    But I guess since your wife is in India you have no choice. Consult your lawyer also in this case so as to keep him in the loop and get his advise also.

    its good to use your OPT card as long as its vaild and then move to H1, there is no time frame for stamping, its always good to go to your home country and then get it stamped,but once you start working on H1(your payrolls starts on H1) then your H1 clock starts

    Do anybody know what are the documents that i have to provide to my new employer for the H1B transfer process. I heard that i need to provide all my PAYSTUBS along with my orginal H1B papers.

    Is that true ?

    All,

    I am in a bit of confusion and needed some info. I had applied for I-485 during July fiasco and my spouse applied as derivative. We had applied for her H1 extension/transfer through another employer after we filed for I-485 as we did not want her to use EAD. We recently received her H-1 approval without I-94.

    I am not sure at this point if she has to leave immediately to get the h1 stamp Or she can continue to stay here as her AOS is pending based on derivative status of my application.

    Also will her getting approved without I-94 impact her pending AOS in anyway

    if 6 years completed without an LC/I-140, then if someone moves to H4, does LC+I_140 in say 5-6 months, can he/she come back to H1 (3 year extension?)

    How difficult would it be to work with the USCIS dept to "allow" filing of I-485 stage on a continuous basis when priority dates are not current? In the current scenario they are pre-adjudicating cases up to July 2007 and are allocating visa's number to them as and when DOS makes them available. They can might as well allow a continuous filing of 1-485, pre-adjudicate them, and then we can wait when DOS gives the visa numbers to get the GC. On the USCIS side of things they will at least reduce their deficit, from fees for i-485, EAD, AP, Renewals. On our side we get the EAD which eliminates employer dependency, visa stamping, visa renewal, proving employer-employee headache. This may sound like a baby step to streamline the GC process. Will this need any type of legislative effort? Is this possible?

    If she entered without inspection she will have to process her green card in her home country unless you can get a waiver. But if she came here legally and her I-94 expired you may be in luck. You will have to file I-130, and I-485 for her. You will also have to submit I-130 for her son who will apply for an immigrant visa in Nicaragua. You may want to talk to an immigration attorney who will be in a better position to direct you on this.

    Also this forum is mainly targeted at employment-based immigration and you may not get answers here for a family-based immigration issue.

    In a recent decision, RUIZ-DIAZ v. UNITED STATES OF AMERICA, the court ruled that Petitioners who filed or will file a Petition for Special Immigrant Religious Worker Visa (Form I-360) with United States Citizenship and Immigration Services (�USCIS�) on behalf of individual beneficiaries are hereby notified that you or your beneficiary may now file an Application for Adjustment of Status (Form I-485) and, if your beneficiary seeks employment status as an adjustment applicant, an Application for Employment Authorization (Form I-765) even if USCIS has not yet issued a final administrative decision regarding the I- 360 petition. Previously, the I-360 had to be adjudicated before the adjustment package could be filed.

    The Court has invalidated USCIS� bar against concurrent filings as an unreasonable
    interpretation of the governing statute. Pursuant to an order dated June 11, 2009, USCIS is required to accept as properly filed adjustment of status applications (Form I-485) and employment authorization applications (Form I-765) from individuals who are beneficiaries of petitions for special immigrant visas (Form I-360 (http://www.h1b.biz/lawyer-attorney-1137192.html)), whether submitted concurrently with or subsequent to the visa petition, provided the applications meet USCIS� valid filing requirements.

    Bear in mind that this decision may be subject to Appeal, so things can still change. But for now this is a victory to the applicants filing under this category.

    Hello,
    My friend has H1 and working for company A. He transferred his H1 and started working for company B (Its been 4 weeks and he has 2 paystubs from company B).

    He is sure that company A didn't revoked / cancelled his H1. Now he wants to move to company A (old one). Is this possible?

    or does he need to re-transfer his H1 from copnay B to company A?

    Please advise.

    He/She can join old company as long as H1b from the old company is not revoked. There is no need for any H1b transfer as long as old company's H1b is valid. Just go and join them back if they are willing to take him. Lot of people of H1b do this. Hope this helps.

    Hi,
    I have a pending I-485.
    My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

    You PD has to be current to file I-485 for you spouse/dependent. Since you filed for I-485 in Jun '05, and based on ur PD, i guess ur case must be EB2. If EB2, then you are in a better position alteast compared to many folks here.. The PD for Mar '06 per DOS, Visa Bulletin, for EB2 is 01JAN02, Since your case has a PD of Jan 02, (Date not provided by you),

    Watch for April VISA BULLETIN, The DOS publishes this ususally sometime in first 2 weeks of each month for the following month. If the Date moves forward you should be able to file sometime in April, assuming the Date moves forward. Also you can use this time to prepare the application.
